Last week a Kendall County Judge stopped the Illinois Department of Financial and Professional Regulation from taking away a Chiropractor’s license. The Illinois Department summarily suspended the chiropractor’s license in February of 2015 for an issue unrelated to his practice. At the hearing, the Department had no evidence, and instead relied solely upon the fact that the chiropractor invoked his Fifth Amendment right not to testify. The ALJ found that that was enough to continue the summary suspension, and continued the suspension indefinitely. The Department had no witnesses and no evidence. Goldberg Law Group filed a Complaint in Kendall County and a Motion to Stay the Discipline imposed by the Department. The Judge agreed and the Chiropractor has his license.
